can my wife use a attorney in a divorce proceeding against me if he has represented both of us jointly in the past or would this be a conflict of interest

Not sure about the US but I would have thought that it wouldn't be a conflict of interest if the business he is dealing with at the moment is just the divorce.

It rather depends on who gets in first I suppose.
