In E&W you can divorce on the ground the marriage has irretrievably broken down citing 2 years separation with consent, 5 years separation without consent, unreasonable behaviour, adultery, or desertion. Desertion is very rarely used and many people do not want to wait 2-5 years so they use unreasonable behaviour eg controlling, selfish, lack of interest of an intimate nature, not helping with chores. As well as the actual divorce It is very important to ensure there is a final settlement order so that no future financial claims can be made against each other.

In Scotland divorce is granted after one years separation with consent, 2 years separation without consent, behaviour or adultery. It is no longer possible to cite desertion. There is a strong burden of proof required for unreasonable behaviour and adultery and as a consequence 92% of divorces are granted on one of the two separation grounds. The finances are normally settled before the divorce is granted and no future claims can be made against each other.
