I WORK FOR A LARGE NATIONAL COMPANY ON A FULL TIME BASIS. I HAVE A STRAIGHT CONTRACT FOR MY HOURS WORKED. I TOOK ON A NEW ROLE WHICH BASICALLY IS ON CALL OVER THE ENTIRE WEEK END AS WELL AS 3 DAYS DURING THE WEEK. I START AROUND 0530 ON THE SATURDAY MORN AND REMAIN ON CALL UNTIL 0800 MONDAY MORN. THROUGHOUT THE DAYS OF THE WEEKENDS NOT ONLY AM I ON CALL, BUT I HAVE PRE SET TASKS TO ACHIEVE. MY QUESTION IS AM I ENTITLED TO OVERTIME PAYMENTS?
This is an incredibly interesting question. Please respond.
What are the terms and conditions of your contract? Even if your terms and conditions apparently oblige you to perform work outwith your normal hours, it may not meet the required standards set in law!!
You are on-call. When you are on-call, what do you get out of it simply for being on-call, and what do you get if called out? Answer that and I can point you in the right direction. I warn you though: I suspect that some of the issues in the back of my mind cannot be easily solved and may involve some deep and lengthy legal assistance. It's that serious!! :-)
For being on call i recieve £17.57 both days of the weekend, £35.14 in total. I recieve nothing for being called out, no matter what time or freuquency. My contract is a standard work your 36 and a quarter hours and you will then acquire overtime. I work a full three days (0800 - 1630 ) during the week, and then start being on call and working sat + sun. The set tasks i mentioned have to be done at 3 set times of the day; morning, afternoon and night.
