Suing the NHS

I am asking this question on behalf of my mum.

2 going on 3 years ago she had her appendix removed, Since then she has had no end of problems.

When removing her appendix they managed to damage her bowel which now has scar tissue inside and causes her great pain. I dont know the full story but she also has no feeling of when she need a wee. The hospital have said verbally it was there fault they have damaged some nerves there is a way to sort it but due to the cost they can not do it on NHS. For the last 4 days she has been in bed unable to move due to the pain she is in and last night had no choice but to go to the hospital. As this is an on going problem they said there was nothing they could do and she looked very well if she was in as much pain as she was claiming. she is taking opium based tablets on a daily bases and also has some pain killer patches she can put on her stomach but these no longer seem to help.

With the very limited information I have given above what would the chances of been able to sue the NHS be. We are not suing for a profit we would like to get some money to put it towards private treatment to sort out the problem if it is actually fixable

Hi Ian124.

I had a hysterectomy 4 years ago, it went horribly wrong and had to have an emergency 2nd operation to save my life because someone within the hospital had lost some incredibly important information.

If you want to sue the hospital, as is your right, you do need to start "the ball rolling" now as you have only 3 years in which to make a claim.

My claim is still outstanding and looks like there will be no satisfactory conclusion as hospitals/NHS have an excellent capacity of sinking their head in the sand.

I have also written to my local M.P again with no joy... I'm left in constant pain now for the rest of my life, I am 42yrs old!!
