Legally binding?

OH has had a contract with 02 for nearly 5 years. He's paid phone insurance the whole time. He broke his phone but because he switched the sim card to another phone they say he's not covered.

They have said over and over again that they will contact him...but nothing.

He thinks that they have broken the contract......

If he just pays the bill can he get out of the contract?

I'm with 02 and I have never had an y problem with matters covered by insurance, I don't understand what they are saying. I would go camp in my local 02 shop until they sort it out.

They said because he swapped the sim to another phone that he's not covered.....
Phone 1 is insured, he's trying to claim. In the meantime he put the sim in another phone so he could stay in contact - if it's vital that he can be contacted, Admittedly when OH's phone broke last week, we went to the 02 shop and because we had insurance, they gave him a loan phone until his own came back. They did charge £25 deposit which we got back no problem when we handed the phone back. You need to look at the small print on the insurance - depends which policy you have

Cheers Boxy....he just wants to pay the bill and get out of the contract. According to him he has tried everything but they have not returned his calls.

He asked for a new sim card but they haven't even sent that....In the end he cancelled his DD to them.

Now they are threatening him......he's never had a debt in his life but is sticking to his guns out of principle.

He is refusing to pay because they haven't sent out a new phone or sim and he's paid insurance for the last 5 years.

(Ithink he should pay it btw)
it's all very well him "sticking to his principles" but what happened to sticking to his side of the contract, or don't his principles extend that far :)?
seriously, what does the (insurance) contract say? and how do they even know his sim has been put in another phone?
is it the handset thats covered, or the sim...(ie, whichever phone the sim is used in?)
maybe this is the issue...

i would say the sim is yours separate of the handset and you can put it in any phone you wish

He's paid insurance the whole time....not just on his latest phone but also on his old phone as he'd need back up for work.

They said that they would get back to him...but haven't. His calls go unanswered or they take a message but don't ring him back.

but WHAT does the insurance contract say?
