hi all im at my wits end just been charged with GBH with intent a person has accused me of stabbing him i was in bed at the time my wife has confirmed this they have no dna no weapon it was raining at the time they took clothing which were all dry ive never been in trouble before i have only met the person once and that was for five minutes to ask him to stop picking on a OAP and it was all amicable any help would be good thanks

How is it you have been charged if there is no evidence??

no there isnt any evidence but because i said to police when they told me he had been stabbed what i am i supposed of done stabbed him on his doorstep and thats where it happened and i only said that because i was on his doorstep three days previous

yes ive seen a solicitor and they have said as its one persons word against another with no other witnesses in small cases they send to crown court for a jury to decide

Well if they have no evidence they won't find out any evidence...

Why would someone accuse you of this?

excactly why would you do this to someone it took him 1 hour to phone the police and report it

The police tend to be good at their jobs. They will find holes in his story. Not many people are good liars. They think they are but they need an impeccable memory.

How do you know it took him an hour to call police after the alleged incident?

Where is the knife used to stab him?
Fingerprints?
DNA
Any blood on your clothing?
Witnesses?
Also - what motive do you have? And how does he know where to find you and who you are if you have only met once for five minutes?

he has told two completly different stories in his statements and they still charge me

i have the papers with his statement they have nothing apart from the statement i made the reason they found me was because the police went round to the OAP house and she told them where i lived

I dont understand why you met him three days prior to the incident for just 5 minutes... (I presume this was on his doorstep) then three days later he is stabbed and blames you.
How did he find you - does he know you
Where is the weapon...
You need some serious legal representation if you are innocent of this

Can you prove you were in bed at the time of the incident? Had you been watching tv? What was on?
He surely must have some previous for being a trouble maker or nutter?
Normal people dont normally behave this way!
What is your motive? You apparently left him after an amicable discussion

This is all very odd, plod will not charge you unless there is evidence. They know the CPS will boot it out if they have nothing, even if it makes it to court any brief will rip it up for ar5e paper. You will not be found guilty with no evidence. Just plead not guilty and continue to tell the truth. Hopefully they'll get some evidence that points away from you and they'll drop it.

So has he accused of this because you went round and told him off?

If there is no evidence it is unlikely CPS will proceed but you should seek proper legal advice.

as i said i went to see him to ask him to stop picking on the OAP and no they have no knife no dna and no witnesses yes he has been stabbed in the arm but not by me

If this incident happened months ago (and from your previous threads I'm presuming it did)... why have you not seeked legal advice before?

This is a serious crime you are being blamed with - and you should be getting expert advice from a lawyer.. not a chat forum really.
Much as we like to help here... a lawyer will deal with the specifics of the case and seek out where stories dont match up

yes it happened in december i have taken legal advice but i am on here as it will be the public who will be the jury and i am scared
