Would it be legal to use bits of previous films to make a whole new film? not quite in a Dead Men Don't Wear Plaid sort of way, but along those lines. I was thinking of using clips of pathe news reels and adding my own commentary. I would be using the previous images, but not too large a chunk of the ideas and skill, and I heard that was how musicians are allowed to sample drumbeats and stuff.

You can as long as you have permission from the owners of all the clips your planning to use. The same applies to sampling drumbeats and stuff. The owners usually claim royalties too.
