warranty issue

hi there my son bought a car(private sale) and the owner gave him a receipt for a re-conditioned gear box supplied and fitted by a garage in glasgow at a cost of 295 pounds,the clutch went on the car and his friend who is a mechanic was fixing it for him and he noticed a hole in the gear box, he foned the garage(as the gearbox has a 12 month warranty) andthe guy in the garage says he wont fix it as "he did not put the gearbox in for him but put it in for the previous owner" the gearbox was fitted 05/09/11 so still has a month left on it can anyone advise what to do ? thanks in advance

Probably nothing you can do, you have not and have never had any sort of contract with the suppler of the gearbox so they have no obligations to you at all.
