I bought a 5 year old car 6 months ago from a large reputable dealer.
When I tried to tax it online yesterday I found that there was no MOT on it !
I checked the paperwork and found that although they told me that it was MOT'd when I bought it, they had forgotten to do so, and the MOT which was in with the paperwork was actually LAST years !
This means that when I drove the car away from the garage it was without an MOT and I have been without one for the past 6 months - hence,
NO INSURANCE !!
They have now MOT'd it and put £40 worth of petrol in it as compensation.
My other half has gone mad and say that I should get more compensation as they put me in a very serious situation if I had been involved in an accident.
What would people suggest please

you would have still been insured, even with no mot

If you have accepted the new MOT and £40, then that is an end to it, be glad nothing untoward did happen, and check all paperwork closely in future.

Thankfully you werent in any accidents , you really should of checked all the relevent paperwork yourself as a matter of course imo , if youve nothing in writing re the MOT i dont think youd have any recourse with them so id just accept the petrol youve been offered

Yes, they sound quite honourable in getting you sorted plus a tank of petrol. Good guys.

I think OH is being a little bit greedy and needs to think what she wants compensating for exactly? Loss of what? Alls well that ends well, I say.

As previous posters have said, you have been fairly dealt with..

Had you been pulled over by the police, I'm pretty sure I'm right in saying no MOT is a non-endorseable offence but does attract a fine: had this happened, I'd've expected the garage to do the MOT, pay the fine and make a goodwill gesture, such as the £40 of fuel they've given you.

It was an honest oversight - compensation is not warranted.

Result, I'd say as it is 100% your fault, you did very well. I don't see how your other half thinks the dealership is somehow responsible because you did not validate your paperwork. As others have said it is a bit of an urban myth that every illegality somehow voids insurance. If it did the every motoring offence would also include a prosecution for no insurance, clearly a nonsense. Now if you'd needed to claim during that period the insurance would use the lack of MOT as a stick to beat you with of course!
