Lane 3 On U K Motorways

i was always led to believe that vehicles pulling trailers - including artic trucks - were not allowed to use lane 3 on a UK motorway. Having driven nearly 700miles in the last 2 days, I've seen so many 3-laned elephant races that I'm beginning to doubt my memory.
one of these (on the M20 at Lenham) was in full view of Constables Plod from the Kent Police, so it must now be legal, right?

points 1 and 2, routinely ignored by everything, particularly UPS, and TNT - in fact to the point where observation shows rigid trucks of any size were now exempt
point 3, routinely ignored by megabus - national express are better but still do it
point 5 - routinely ignored by a particular type of driver, eg driving a 4x4, shaved head, tattooed neck, England shirt, usually pulling a boat - now it seems artics are to be excused point 5 as well.
clearly Plod has no interest in supervising the anarchy I see every day.
