Driving Licence Renewal With A Photo
hope somewhere out the can help me.
To cut a long story short, i need to renew my old fashioned paper driving licence for one with a photo. My concern is that i live in Spain, so all my post goes to a friends address. the point im trying to make is in the application form they ask for your current uk address. Would i breaking the law if i put down my friends address?

It is, Corby. My sister-in-law has never driven, never had a driving licence and has been living in Spain for many years. She has bought and sold property, opened bank accounts, dealt with all the authorities without problem.
Brits living in Spain have to have a TIE which has a photo so I don't know why you can't get one, piggy - it's a legal requirement

Would the definition of 'ordinarily resident' that's long been used in immigration cases be relevant here?
"Unless, therefore, it can be shown that the statutory framework or the context in which the words are used requires a different meaning, I unhesitatingly subscribe to the view that "ordinarily resident" refers to a man's abode in a particular place or country which he has adopted voluntarily and for settled purposes as part of the regular order of his life for the time being, whether of short or long duration."

Section 108 (1BA) of the 1988 Road Traffic Act defines "normally resident in Great Britain" but it goes on for a bit so I'll not bore folk with the exact details but this link takes you to section 108.

In reality all piggy wants a licence for is identity. The address on the licence is the one to which NIP etc will be sent and, since piggy has no intention of driving, this will not be highly relevant; the only likelihood of contact from DVLA is to remind him that it's renewal time and, in any case, any mail sent to the UK address will find its way to him. Given all that I don't really see any reason why he shouldn't swap his paper licence for a photocard with the UK address that he is in contact with.
Well, the licence will be sent to the UK address and will find its way to you eventually by some means.The chance of being prosecuted for giving false information is virtually nil since, other than renewal reminders, they will never have a reason to contact you. So long as you don't use it as a Driving Licence I can't see you having any problems.
