insurance problem

Hi all, your advice would be greatly appreciated! I was rear-ended whilst in a queue for traffic lights last week. The guy gave me his details, and after a week of trying I have just got hold of him (apparently - he owns an insurance approved repair garage, hmm) and ironically it turns out he is uninsured. He has offered to carry out the work, and im unsure what to do. If I don't accept his offer, Im not going to get my car fixed! anyone been in a similar position? can anyone pass on some words of wisdom? Thanks in advance, Jamie

Hi there, this all sounds a bit fishy to me. How do you know the repairs he does will be upto standard or roadworthy.

Have you contacted your insurance? If not contact them and let them deal with the matter. Following an accident I had I never had any dealings with the people involved once we had both left the scene, I left it all upto the insurance people.

Not sure how it would affect your no claims, but I think your insurance would cover it?

Obviously its entirely upto you, but I personally would hand the matter over to them.

Uninsured drivers should not be on the road, and in my opinion deserves all the trouble he has coming to him, he needs to be taught a lesson.

I had exactly the same situation 4 or 5 years ago, and I gave the guilty party the OK to carry out the repairs 'himself' The car was returned at night when it was dark but looked OK until I examined it the next day. It was a very amateurish 'bodge' - Hand it over to the Insurance company, dont wait.

Thanks Lou and Scrambler, problem is if I hand it over to the Ins Co I dont get my car fixed, if I call in the law, I dont get my car fixed, and this geezer gets a fine or something. It seems like lose lose.

if you have fully comp, insurance of course you will get your car fixed, thats the whole point of paying the extra money for it, but if you are only third party then you are in a spot. you could always send the lads round.
