driving without insurance x2
28 Answers
my boyfriend has previous convictions on his license , driving without insurance ( he got 3 mth ban and fine) and running a red light (3pts) then recently he got caught with no insurance again after gettin his license back and he got 6 mths ban and 400 fine. We went out one weekend and he was driving up the road and got caught speeding on daul carrage way by police with gun and van, and his mum took the wrap (at least she fort she did) and today theyve produced a pic of him driving. Anyone know what will happen to him now? Last speeding offence he still had license. how can he get banned for no insurance if thats wot he's already banned for? HELP!

driving whilst banned can result in a jail sentence. Being a persistent offender (3rd time he's been caught for same thing), this seems likely.
Sorry worried_gf, but he deserves what he gets. I have sympathy for getting done for speeding (we all do it at times), but driving without insurance is inexcusable.
As for his mother, theoretically, she could go down too (perverting the course of justice? fraud?), but that's unlikely. She could well get a fine herself as well though.

JudgeJ : he wasnt banned when he caught 2nd time. he had his license back bout 6 mths before he did it agen. And as for the 1st time, the whole drving thing was new to him and his mum told him that he was insured, but when he got caught 1st time, the policy had ran out by 2 days and he wasnt notified of this. as for the letter that came today, he was caught speedin on dual carrageway 3 days b4 his court date for IN10. (no insurance) so no he still had his licence. To be honest with you, i no im stupid 4 getin in the car wiv him, but im sik of repeatin myself all the time for it to go in one ear and out the other. And i also think that he shouldnt take all the wrap for it, coz everytime he's got caught his mum has been in the car, so shouldnt she get done for letting him drive coz its her car??
I think you may be worried about the wrong thing here.
With his mother claiming to be driving when in fact he was there's a potental charge of attempting to pervert the course of justice.
In a recent case a driver tried to escape a speed camera ticket by moving road signs - he's facing a custodial sentence for attempting to pervert the course of justice

If your boyfriend and his mother have both lied to get him off, that's pretty serious for both of them and a ban could be the least of his worries

Do you honestly value yourself so little that you think you deserve to hang around with a guy like this ? Not just totally irresponsible, but he is probably paying more in fines than he would with legitimate insurance ! WHat an idiot. Meanwhile, honest motorists have to subsidise his driving so he is effectively stealing off all of us. At the stage he is at now, he is going to find it very difficult to convince a court that he is genuinely sorry and has no intention of doing this sort of thing again. As a repeat offender, he could be looking at a worse penalty than fine or driving ban as the maximum for this is imprisonment and confiscation of the vehicle (it gets crushed). Obviously he doesn't deserve to be on the road, and the law will do what it has to to protect the rest of us. His mother is obviously pretty stupid for encouraging him and you are not much better yourself for going along with it. At least this will get him out of your hair for a while and give you chance to replace him with a human being.

we dont live on a council estate and i love him. I dont give two s***;s wot u lot think of him, i just wanted adult advice just to see if and how long he would get sent down for. And to be honest with u all, i think putting him in jail will scare him enuff not to eva drive agen, or even to insurance his fkin car! u dont now how much it does my head in that he dnt listen to me, and readin all ur logs i agree with sum of u but i dont wish death of anyone. thnk god he aint killed no one. he aint driving at the minute, coz i got his car towed away. and the worst thing is all of us were in the car (my son too) im seeking legal advice as u lot dont seem to be helping.
I rather thought you said his mother claimed to have been driving when he was sppeding on the dual carridgeway.
If the car belonged to him he would have got the request to say who was driving - He'd have then had to say it was his mother for her to have taken the wrap.
So that's when he'd have lied and committed the offense
I guess if the car belonged to her and she said it was her driving without saying anything to him, then she'd have been the only one lying.
Or have I mis-understood?

so a custodial sentance will make him realise that he was wrong eh? Why didnt the first points and fine? Why are you sticking up for him (and his mother) when you have realised that he was prepared to drive an uninsured car with both you and your child in it?
Ward-minter does come across as a bit OTT but thats no different to what any other parent would do if their child was hit by a driver, let alone a driver with so little respect for safety and insurance. W~M gave it bluntly thats all.
As for you being sick of telling him, why are you even still getting in his car. How does that enforce the point that you dont like his driving skills or attitude?
You say his mum should take some responsibilty as she was in the car? why? If you were in the car can it not be blamed on you? Or your child when theyve been in car? His mum will no-doubt be questioned on giving false information because perverting the course of justice is a stupid thing to do but shes not at fault for the way he drives.

the car is his mum's, and when he got caught speeding on dual carageway, she sed it was her driving, to protect her own son, i suppose. but the picture has cum up that a man was driving the car.
i know that he shouldnt be driving, but surely his mum should get done for letting him drive her car with no insurance.
Im not coming up with excuses im trying to get my head around it all. i came on here for advice as a worried g/f and all i get is abuse... f*** this

If his mum deliberatly said he was driving (if its her car she may have automatically owned up thinking that it was her) then she will no doubt get done for it.
Saying that all you get is abuse is incorrect. Ok you have had some but most posts were just stating facts.
What did you want us to do, go and lynch his mother and say that its all her fault and hes a good little lad really.
How many times does he need to do this before you realise that he doesnt seem to care if insured or not. Leave him to face the music himself and own up to being in the wrong!

I'd think he'd be lucky to escape a custodial sentence for a driving during a ban and a third driving without insurance.
As the car's his mothers it sounds as if he's OK on the attempting to pervert business as long as she doesn't do anything like say he put her up to it.
However there's also a relatively new offense of allowing somebody to drive your car without insurance. Like you say I'd think she could be charged with that too.
I'm also little worried with the fact that you said "We went out". I don't know whether you can be an accessory to "driving whilst banned" but I certainly wouldn't tell anybody you were in the car unless you have to if that's what happened.
