2001 Hyundai Accent - Slipping Clutch. Warranty Issue

Hello all,

I purchased a used Hyundai Accent (51 plate) from the Hyundai Dealers. And now the clutch is slipping.

I've rang them to see if they will fix it because I've only had it for 4-5 months. They wan't me to drive to them to have it checked for "abuse"
Anyhoo, I checked my Waranty/gurantee paperwork. It says I am covered for upto 40k miles - it was on 38k when i bought it, and I'm worried that they'll refuse to repair. It also mentions in the section about clutch gurantee that they wont cover "frictional" parts. (i thought the main part of a clutch IS frictional! - get out clause?)

Their gurantee, in my opinion, is unfair. According to consumer rights I have a right to expect a certain level of "Durability" from any car I buy. Can I use this if I have any problems, or has anyone been in a similar situation that can advise me?

I want some ammunition before I ring them back, please help!

I think you will find that all used car warranties exclude certain items - typically friction linings such as clutch and brakes, exhaust, battery.

It is near impossible for the garage to have known the condition of the clutch when they sold the car without dismantling it. The fact that it worked would have been acceptable although there may have been indications that it was worn.

How they are going to prove any abuse is where they will fall down. There is virtually nothing they could do to prove that and that is the issue I would be concerned about. OK they could dismantle it and claim it had been overheating but I doubt that.

If you a member of one of the motoring organisations I would speak them for advice. If not your local Trading Standards could advise.
