Can someone answer my question please,I had just driven up a secondary road with no parked cars on my side of the road but with parked cars on the otherside of the road I had passed about four cars when a car coming down in the other direction came down in the middle of the road I had to get over to the nearly the kerb and the driver hit my wing mirror when I challenged the other driver stating that he had hit my wing mirror and he said I havn't done any damage it's only a wing mirror but when I inspected my wing mirror he had craced a plastic strip that goes around the wing mirror that houses an indicating light.When I put it to him that it was my right of way he declined to answer,I asked him if he wanted to pay for this privately or insurance co he said insurance co as the bill only came to �61 I informed my insurace co. They now have informed me that insurance company are willing to go 50/50 but there was no damage done to his car and it was his fault but it seems I can't win.Has anyone on answerbank any advice please. Thanks in advance.

Tell your insurance company that you won't accept 50/50 as (from your description) it was your right of way and his fault. Remind them that you pay your premium for them to fight on your behalf! Also threaten to take your business somewhere else come renewal time. Thats normally the sort of language they understand. Good luck!

Thanks sddsddean, I had al etter from my insurance co that I wasn't prepared to accept 50/50 as it wasn't my fault and they told me they were going to review the case,I had a letter yesterday from them saying that the other drivers insurance co was only prepared to go 50/50 so I told them that I was prepared to take him to a small claims court but I was told by my insurance co that I might or might not win the case so I was throwing my money away so I yesterday accepted defeat.I think I am too late now to change my mind.

you are too late to do anything about it now I think, since you accepted 50/50 - I might be wrong.

Thanks ugly_bob,I think you are right my wife is so insensed that my insurance co did not act in my best interests that she is going to write to them to cacel my policy,but i don'y want to cacel my policy they are a good company in general.
How do you validate that comment Dodds? The one time you need them, they end up costing you money and still expect their premium thank you very much! Ditch them and go with someone else. There are plenty of companies out there after your business.

Thanks sddsddean,I know you are right also my wife but I had two bangs in the last three years that was not my fault and they acted in my best interests and won both cases.
