Excessive speeding - points and a fine?

Im a fleet manager and one of our employees was caught doing 103mph on a 60mph rd. Personally I think he will receive a hefty fine and possibly 9 points, because isnt it 3 points per 10mph over the limit? (just a rough guess).

He was not photogrpahed, but was caught by a handheld speed gun.

Anyone have any ideas how many point he may hereceive, and what size penalty?

He is likely to have to attend court as the speed was so excessive. The magistrates guideline for this offence is 6 points or possibly disqualification for up to 56 days. This is for the offence of doing 31-40mph over the legal limit on a 60mph road.

There will also be a fine. This will depend on his income but if he pleads guilty - it will be lower.

he was doing 43mph over the 31-40 bracket - will this have more of an impact?

It may well have an impact, particularly if he already has any points on his licence for speeding.

If he already has 6 points or above he may well be disqualified as a totter - someone who has accumulated 12 points on their licence - and could be disqualified for 12 months.

Besides what the courts will give him as fleet manager I would assume you have a company policy that would no sack him for gross misconduct. Was this in a car or van?

Policy is now coming down hard on this sort of thing particularly now with the new corporate manslaughter bill and all companies now having to show a duty of care in providing further training to ALL its emloyee who use a vehicle as part of thier job. Just the same way as if they use machinery that they have been shown how to use the safety equipment.

The big question is WHY was he doing that speed?

The normal upper limit (n a 60mph zone) for a fixed penalty to be offered is 85mph. Above this and drivers are usually summonsed to appear before the magistrates.

Their sentencing guidelines only provide guidance for speeds up to 100mph. The suggested penalty for this speed is 6 points or a disqualification of up to 56 days. Your driver was beyond this level and the bench would not be too far adrift if it banned him or her for three months. I doubt that their Worships will think that points are an appropriate penalty in this case as their normal maximum for speeding is six.

I trust that, whatever the outcome (provided it is accepted that the facts are as stated) your company will seriously consider your driver�s future with them.

I don't know if fleet car rules are the same as HGV,but I think your fleet/transport licence can be withdrawn if your drivers persist in breaking the law.

if the driver in question keeps his/her licence and job, might i suggest you take the company vehicle away and supply them with a ligier ambra, or similar. (you know, the 400cc diesel city car that is only capable of 50mph?)

then again, you can still do 50 past a school at 3.30pm in one...

100mph plus is usually an instant ban on the motorways, unless they can prove that they will suffer out of proportion to the offence
