Hi there i hope someone can help me real quick.. last night driving home from work i was involved in a small accident with a motorbike. The women on the bike hurt her knee and little damage and my car bumper was smashed. we exchanged details and then the police were called and i was given a 'producer' Finding my papers today revealed my MOT had expired 3 months ago. I only have 7 days but i can have someone MOT my car tomorrow for one with tomorrows date on is this any good? Also how will it affect the claim they will make against me insurance wise and will i still be able to get my car fixed (comprehensive insurance) ? Please help as im so stressed and confused! Fern.
The MOT you produce must cover the date of the accident. You will not be able to do this, so may (probably will) be charged with 'driving with no MOT'.
The maximum penalty is 1000 (highly unlikely!) and no points.
Re your insurance - you will have to hope for the best. If you were at fault then your insurance company will pay for the biker. But they may not pay for your own repairs if one of the terms is that you agree to keep the vehicle roadworthy and legal.
Unless a replacement bumper is hugely expensive, I would not bother claiming for this repair through the insurance unless it was the third party's fault.
hi... defenstrate i am not trying to get a backdated one ,only as it was a genuine mistake and i hadnt realised it was out of date i am having it renewed tomorrow at least this shows that the car was roadworthy at the time of the accident..although not actually being covered in which case i am ok with paying a fine. however it is more incase the insurance ask for it?
Re insurance...i did not admit liability at the scene but the accident was my fault. The women had hurt her knee so fully expecting a compo claim which hopefully my insurance will pay. A replacement bumper plus labour plus respray will be approx 550. With thier claim my no claims will be hit anyhow and so i should ust try and get mine paid for too? my ploicy has no mention of a valid MOT certificate...maybe it wont be mentioned? Any ideas or help? very strsssfull!
in order for your motor insurance to be valid you must have a current MOT cert, so basically you have been driving around with invalid insurance. I should imagine your insurance company will fully cover the TP's claim (damage and personal injury) but they may not pay out for any damage to your own vehicle...
Sorry I have no answer to post, but adamfernadam, I was wondering, please could you let me know exactly what happened with regards to this incident with you as exactly the same thing happened to me yesterday. It was entirely the other driver's fault and now that I have to produce my documents, I too have an expired MOT. Please let me know what happened with you. Thanks.
