Insured but no MOT

About a fortnight ago my husband managed to go into the back of another car at a junction. On inspection our car was deemed to expensive to repair (bent chasie). We recieved a cheque from the insurance company for the book price of the car minus the excess, along with a seperate letter asking for the log book and MOT certificate. It was only on getting these documents together that my husband realised that the MOT has expired! Of course we havent cashed the cheque yet. Does anyone out there know what happens if you are insured but have no MOT?

I would believe it's a possibility the company might refuse your claim and procede to take all their costs back. Insurance policies are run on the premise that the car is being kept road legal at all times and yours was not.
You may well forfit some of the payout. Frankly I'm amazed they paid up without checking. This is one of the things they normally check before paying out. 3 Courses of action: 1. Cash the cheque but ring fence the money and hope they don't push it. 2) iI they do push it then you can try saying you have sent it already and hope their admnistration is an all too common shambles. 3) Come clean and see what they do.
In the case of 3 you may also write separately asking for your previously forwarded documents back, date the letter a week ago and blame it on he post strike!

Before the motoring evangelists start jumping up and down all the above are just ideas I'm not condoning or recommending any of them, merely relaying the possibilities.

They'll know anyway that it wasn't tested: they'll have checked with VOSA- I'd assume that the assesor or garage that did the estimates noted the VIN for the insurance company's paperwork and the insurer would have checked the vosa database, I'm surprised they're asking for a cert.

Decided to be honest and it paid off. AXA (the insurance company) told us to send back the cheque and they will send out a revised payment for the cost of the car minus its MOT. I was amazed that they would still pay out but they told us that having an expired MOT does not invalidate your insurance, providing you have paid the premiums they wil cover the third party damages and pay the cost of your car if it is a right off minus the MOT.
