hi i drive a company van that has almost bald tyres and the brakes a obviously metal to metal ive spoken to management about this on numerous amounts of times and there reply every time is there isnt a replacement and they cant afford for it to be sat idle in a garage whilst being repaired i was told by a friend if im pulled over it will be me that is liable not the company and my licence will suffer for this i was basically in so many words told if i didnt drive the vehicle i can kiss the job goodbye i would like to know the opinion of others as what they would do in this circumstance

Time to look for a new job.
Yep, you are responsible and would have to take whatever the court dishes out.
As for loosing your job, hit back at them and tell them that if you're dismissed you'll take action for unfair dismissal.
Spot on siggy couldnt have put better myself think about it Matty
You could also point out to the company that not only would you be prosecuted for any offences found on the vehicle but the director/transport manager or whoever is responsible for the company vehicles would also be prosecuted
I agree with sigma and sense4all.
Lets face it if the firm cannot afford to keep their vehicles in good 'nick then theres not much chance of them surviving!
Pay rise? Forget it!
Refuse to drive it as it is illegal.

Put the ball in their court.

If you take it for an MOT and it's that bad, the MOT station may stick a restriction notice on it and you or the company wouldn't be able to move it until it was repaired.
Also the company could fall foul of the HSE by allowing you to work in a dangerous situation
Perfect advise as always guys.

I've had a similar situation with a previous company many moons ago, and i refused to drive it as eventually the metal was poking out of 3 of the four tyres.

I was sacked via some c o c k & b u l l story about poor workmanship !!!!
So, enter a free company called ' Step one ' who fought my case FOC at tribunal and guess who won .....

Do not be bullied by a company/ an employer. You have rights, if not more so.

Best of british - but i would urge you to act swiftly if the vehicle is indeed as you say as i would niether like to see you A: dead / injured or B: disqualified.

Good luck friend

well i kicked off with one of the managers and she finally relented i had to take it to sherwoods to have it checked out as she said and i quote to put my mind at rest as in her the van was fine sherwoods said the front and back brakes where metal to metal it needed new disks on the front and three of the 4 tyres where below minimum requirement they would not release the vehicle back out i gave them her number to ring her as they did and ended up having to walk 5 mile home when i got home she rang me kicking off about how much it was gonna cost to have it repaired and tried to pin the blame on me even though i have own been using the van for 2 weeks and i have been told i have to go in the office on monday for a meeting but she would not say what it was for so i will let you no the outcome
