after passing my driving test i was i was involved in a crash with a motorbike. i had just picked my children up from school. as i came towards the cross roads were i was turning right i slowly edged out as i was about to turn the motorbike came flying towards me. i stopped my car without the seat belts even locking as i was only going about 10mph. the motorbike was going to fast to stop and when in to my drivers side head light causing him to fall off his bike. as my front wheel was just over the white line by about 2inch's. the police have charged me with driving without due care and attention. the witness was all so a bike rider and said he didn't think the bike was speeding. i believe the motorbike was turning right all so there was plenty of room round me not to of hit me. but he saying he was going straight so there he had right of way. as i am a new driver i don't want to lose my licence. i learnt to drive as i am a single mam with 3 children and it would give me better job opportunities. I've all so been with a violent x partner. so having the car makes me feel safer not having to walk about. i no that its 3- 9 points and a fine. what has happened to other people for this and why. what do u think i am looking at. i cant sleep over this. i understand i was over the road but i did stop. and i was only just over.

why did you think the bike was going to turn right?

because to hit me he would of had to be riding on or next to the white line. he was to far over for going straight a head. but the police have to take his word for it. as he was on his side of the road.
oh well - try riding a bike & see how many near misses you get in a day.

its impossible to say what you will get - are you pleading guilty? unfortunately you have no mitigating factors, and no reasonable reason to be able to keep your driving lisense if you do get 6 points. On the plus side, you will be able to take your driving test again and start again if you do get it revoked.

Bikes can often seem like they are speeding even when they arent - i reckon its some sort of visual trick because they are smaller than cars. Even if he was speeding, it dosent really provide you with mitigation. As for only just being over the line, that dosent either - the user of the carriagewy is entitled to use all the carriageway if they wnt

Magistrates' Sentencing guidelines suggest between 3 and 9 points, as you say.

From your description of the incident it seems to be at the lower end of the seriousness scale, and I believe it would be unlikely that you would receive as many as six points.

You will also be looking at a fine of about half a week's net income (reduced by a third if you plead guilty) plus prosecution costs (usually around �60 for a guilty plea), and a �15 "Victim Surcharge".

thanks for that. i cant sleep with worry over this. since been able to drive it has changed mine and my kids lives greatly. i don't want to lose my licence it would have a really bad impact on our lives.
