i am contesting a parking ticket in a retail car park, for parking in a car park for 5 hours when i was only there for 20 minutes. the parking company has photos but they are dark and look like different cars. the number could have been cloned. i am going to court over this and wanted samples of errors by parking cameras to take to court with me.

please help.

I'm not clear whether you are saying it was:
(a) a camera error or
(b) someone with an almost idenical car has a cloned number plate with your reg on and parked in exactly the same spot you had parked in.

the camera is at the exit, not in the car park.

so there are photos of your car, plus an identical model with the same registration plate as yours, which wasn't you?

The pictures provided are at the exit, the pictures are dark and you cannot see the model of the car only the no. plate.
the parking company contends that they do not have to prove that the car as same only that the reg no. is same.
the picture taken on arrival at 3pm is also dark as well..

Is it an official 'pay and display' car park or is it a car park provided for customers of a shop/group of shops which allows customers to park free for a limited period of time. If thelatter, I'm not sure they can enforce these'fines'

The latter, ****** for shoppers that allow free parking for 1and 1/2 hours.

This site suggests that drivers in your position should seek CAB advice.

I also understand that for cases such as yours on private land if they do not know who the driver was, they cannot claim a penalty. They have no legal right to demand that you identify the driver.

Anyway, I'm still puzzled by what you are asking- are you claiming it was a faulty camera or a cloned number plate?

CAB and Trading Standards are hopeless for advice on private parking 'fines'. If you are already going to court best advice is here
