car accident

I was involved in a car accident on thursday evening where i was turning right in a box junction. I approached the traffic controlled junction and was actually in the box junction in the process of turning right as my path was not blocked by an oncoming vehicle. As i was travelling through the junction and my car was actually turning right, another car crashed into my vehicle. He was turning left so the front of his car crashed into my offside wing and passenger door as my car was already side on traveling through the junction. He hit me at such a speed that my car was pushed across the other side of the road nearly causing me to crash head on into the stationary oncoming queue of traffic. I have obviously made a claim through my insurance to say he is liable but he has made a counter claim against me saying i am liable. Im only 3rd party and i cannot get an update until tuesday with the bank holiday. If aanyone can help to put my mind at ease or has been in a similar situation i would love a response.

it's not very clear who was where. were you on the right side of the road, or had you already crossed to the other side? did the other car come from directly opposite you? was the road straight? how far could you see?

Katieg hopefully you will get some expert answers but I wouldn't be too concerned, in my limited experience everyone counterclaims in an efort to reduce their own blame, I think their insurance companies expect them too.

sara3 i was in a right hand lane then entered the box junction and was in the process of turning when he crashed into me. he was coming from directly opposite me and was intending on turning right, but i was already moving, and my path was completely clear before i began moving. yeah the road was straight and when i looked directly down the road before i moved into the junction he was not at the box junction.

Katie, if there is one thing my boss told me when I worked in the insurance business years ago, it was "if you're involved in a accident, write it all down as quickly as you can, and draw sketches". I do recommend you do this - it's all fresh in your mind at the moment but if - as it can - it drags on and on, it's very easy for you to forget the fine details of exactly where you were and who did what, if you are questioned at a later date. Get it all on paper, as much detail as you possibly can, and keep it safe.

if you were both turning to go down the same road then you should have given him right of way, and maybe he thought you were...or do you mean he was turning to his right?

If you were turning right and he was turning to his right he would. have collided with your near side not the off side.
When turning right you should have passed each other and turned behind each other not in-front of each other. It appears you turned across his path so were at fault.

it's still not crystal clear, but it sounds like you started turning with a car coming straight toward you, therefore your fault.

I'm sure you'll have to provide diagrams for your insurance people, so they will decide.
