shared drives

we have a shared drive with parking at the end of the drive our neighbours now insist on parking in the driveway blocking my car in also he is parking across my access to my door preventing us leaving our property safely and when asked to move is abusive. We are owner occupiers and neighbour is a council tenant we are pensioners my wife is blind and i have heart condition.
He insists he has evry right to park in the drive. He is also telling visitors to his house to park in the drive and to leave their car there when they go out. What rights do we have as the council have told us its nothing to do with them but i was of the understanding that as they are council tenants then they are responsible for there tenants.

I do not believe they have any right to block a shared drive. Check the paperwork for what rights you both have. The council washing their hands of the matter seems strange too. If the council own the property I'd have thought they were responsible for any blockage. You may need a solicitor to write a letter ?

I would have thought that if a letter was written to the council, they would be warned about the use of the drive.
Check attached conditions on your deeds.

Write to the council about him. If it's a shared drive you must both leave each other access. It's one of the most common causes of disputes among neighbours, my sister and her bloke haven't spoken to their neighbours for more then ten years because of a similar dispute

There are many shared drives in the area I live. It put me off a bit, but I may have 'bitten the bullet' and gone for such a property had one with its own space not been available. (Higher price/larger mortage, but hopefully it'll have retained value when sold; and no chance of such a dispute.) I think the shared drive design is a very flawed design. A property should have its own boundaries not some kind of grey area between them.

if you ring the council ask for traffics dept. they have are set up for such issues. He is totally out of order and this can be dealt with by the council .I recently had a parking issue which they helped with.

Just ask hime to move it 20 times a day starting at 3am. Even dumb animals catch on eventually.

No one has a right to block access, full stop.

Plan B, Buy an old banger £100 and bash his car out of the way "accidentally" he'll learn!

What about asking your local Police Community Support Office to have a gentle word with your neighbour, that might just do the trick. You have my sympathy and I wish you well. Please keep us updated via this site.

Thank you to every one who took the time to reply unfortunately this is still on going and at present trying to understand wording of covenant!
