road accident

i am involved in road accident , on 22nd march evening i was going for shopping to tesco. i was waiting at traffic light to turn right(south) ,it was green signal , wait for the right side traffic (main road) , when road clear i move forward to turn right , after at the end of turning , another car coming from main road (east side) hit my car at step bumber (near rear passenger door), actually i did n't see that car at the time of turning he was very fast. police came he took my statement and other driver statement. according to police office it was my fault. i inform my insurance co. will i get any points on my licence , or will i have to pay any fine.

very difficult to say but it is the responsibility of the driver crossing an opposing lane to ensure that the way is clear however someone travelling above the speed limit of the road also retains a degree of responsbility. I would imagine that it may be difficult to prove that the other driver was speeding unless you have an independant witness or tire marks that the Police could use to calculate speed so be prepared to accept the full responsibility for it. Unfortunately most insurance companies will penalise harshly even if there is only a minimal amount of fault so also expect your premium to rise. I would not think that this would result in a fine or points onto a licence unless it can be proven that there was extreme negligence or you were driving without due care or attention but that would be up to the Police/court to decide.

We see thousands and thousands of these. Whilst I appreciate that speed can be a contributory factor in accidents, I would need to ask this.

How far down the main road is visible from your position? Do you have the location details as I would love to see this on Google Local.

I would suggest that if you did not see the other vehicle approaching due to it's speed, then the road must be on a very sharp corner, as if it was a fairly straight road, then unless the other car was touching 100, I fail to see how people cannot notice oncoming traffic. If the other vehicle was exceeding the limit (which I assume to be about 30 as it's most likely a built up area), then your car must have been in a hell of a state, and the police would have known that it couldn;t have been your fault.

Sorry to sound so negative here, but far too many people rely on ''the other person was speeding'' excuse rather than simply admitting that the though they had enough time to pull out or simply didn't pay enough attention to the road.
