I got done for drink driving 2 weeks ago. I have been drivng just over a year. Will I need to resit my test again?
(The judge never metioned anything about it)

i think its 6 points within first 2 years of driving is an instant ban. But i reckon you will have already been banned.

How about you explain the reason you were found guilty of drink driving and red may change her mind, maybe they got the wrong person?

Not a great start to your driving life really is it.

Normally the forced retake is only given to high risk offenders, which are people caught twice within 10years, or are more than 2.5times over the limit.

as you obviously don't fall into the twice in 10 years it would depend largely on how much over the limit you were, if less than 2.5 times then you probably won't have to do a retest.

You should have also been given the option (or you will receive a letter soon offering it) to pay for a drink awareness course to have 25% removed from your ban.

Why not call the solicitor that represented you and ask them though.

chuck, new drivers have to retake test if they get 6 points in first 2 years i think.

I was just over the limit. The reason I ask is because you dont get any points on your license for it just a ban.

i hope youve learned that the best way to avoid being over limit is not to drink at all when driving!

When my friend got his license back fom a ban he had no points on it.

what offence were you charged with? there are 2 different ones i think, one carries points, one doesnt.

Ive looked everywhere. Notice for DR10 it says a mandatory ban but doesn't metion anything about points. The law is confusing indeed

no you don't get points for a drink driving conviction, it's a ban, when you get your license back you will have the DR code on your license which will remain on there or 11 years but no points

No points on your licence BUT the DVLA MAY order a retest before you get your licence back.

It is entirely down to them.

I�ve not read all of this thread but the �Motor Law Answers� provided by redcrx is wrong.

It is a well known anomaly of the �new drivers� revocation rule that it only applies to drivers who accumulate six points, not to those who are disqualified. You can have either a ban or points for a single offence, not both. As excess alcohol attracts a mandatory disqualification, your full licence will not be revoked and you can carry on driving as a qualified driver after the ban.

The DVLA will not order a re-test under these circumstances. It is not up to them, it is up to the magistrates and they are unlikely to do so.
