Whos fault is this car accident???

me and my friends were parked in a car park. i was in someon else car talking. My other friends were handbreak turning and messing around in there cars all around the car park.
i decided to go, i got into my car and my friend was in his car next to me. he was parked!
i done my checks and started reversing.
Then suddenly my friend reversd sharply behind me, and the back of my car went into his!
my car is ok, but his has got a big dent in the side and the door is crooked.
He was also not alowed to be driving as he came out of hosptial two weeks ago after an operation on his toe, so it was in a cast!
of course i got the blame and he said my insurance should pay for it. im only 17 and hes 19.
whos in the wrong? and who should pay?

For more on marking an answer as the "Best Answer", please visit our FAQ.In that case, lt the insurance companies sort it out, but I would guess that your 'friend' wants to win the claim as much as you do so unless the car park has CCTV (something you could check) it will be your word again his, and probably be 50/50 award which will incur penalties on your next policy.

The police take a dim view of people driving in bare feet or inappropriate footwear such as a plaster cast.
Tell you insurance company what happened, don't mention what you were or your friends were doing, as far the insurance company are concerned, you were in a car park full stop.
Don't forget to mention that your friend shouldn't have been driving and that his foot was in a cast.
The public have permitted access to car parks so the rules of the road do apply, it is not regarded as private property.
Let the insurance company sort it out but don't accept a knock for knock decision and make sure your no-claims is protected.

but i have sorted it now!
just thought u wud like to know me and my friend sat down and agreed that it was both of our faults and to pay for our own damages to our cars and that it wasnt worth loosing a friendship over it....(or our no claims bonuses)
we are both happy and our cars are as good as ever!
So to all you negative basatrds who wrote on this post giving me abuse can **** off!
and i appreciate every one else tha helped :)

Like the others have said, it's up to the insurance companies to ultimately decide who was responsible, and there's not a lot you can do about it.
Don't be surprised if your insurance premiums do go up though; young inexperienced driver + any type of claim = huge insurance costs!
It's a pain, but learn from it. If you're really got 'naff all' to do, and you don't want to sit about on your arse all day then why don't you get a job, earn some money and stop wasting your life hanging around with idiots who use cars as toys, before you get seriously injured or end up with a criminal record.
