Parking near a concealed entrance

My neighbour will insist on parking his van at the side of the entrance to my drive, my house is on the corner of the road and i can't see any cars coming round the corner and they will not see me coming out off my drive if he is parked there. Is he breaking the law by parking his van near a concealed drive.

Hi Bob, a bit of advice to sort these Ignorant BSDS out I had the same prob a year or so ago, first have a word with the person make a not of the date, time, I would also take a few pics with a time dated Digi Camera, also take measurements of how close he / she is to the entrance of your drive, when you are doing the pics try & do it with the person seeing you & if he/she asks if there is a problem tell him/her what the problem is, he/she is obstructing your vision for exiting your drive & there is every possibility there could be an accident because of the van, how close is the van to the corner? get all your facts right before a complaint is made, I have just got in contact with my Insurance because of a person that is doing the same thing but he is directly opp my drive thus causing a problem as I reverse in, I do not expect him to park elsewhere only to use his bloody head, mind you, some of them have brains in the ars.

It's a very difficult case form an insurance point of view. If you pull out fo a drive or side road, even with an obscured view, liability normally rests on you.

You could argue mitigating circumstances in that he has parked in such a way that you could not reasonably avoid the accident and draw him in as a negligent third party, although I am presently unaware of any relevant case laws.

The only real courses of actions are to:

1. Speak to the neighbour concerned
2. If he refuses, park you car there until he gets the message (as my parents and their neighbours have done to one inconsiderate neighbour)
3. Speak to the council parking department and see what they say.

I'm sure the highway code only covers parking within x feet of a junction, and not a driveway, so not sure if there is actually any case in law for him to move the van unfortunately.

You could always arrange for a local chav to steal it/burn it out as alast resort!

He is parked within the legal limit from the juntion but as you both say he is bl**** inconsiderate i have an "H" box acoss my drive entrance and he parks right on the end of it, i will try the council and see what they say Thanks

I feel for you I had the same problem.. I have a concealed drive and when I pulled out almost smashed head on with a lorry�. But I�m on a new housing development so I contacted the builders that are still on site. After about 100 calls and me going in the sales office and when they was trying to sell the last reminding homes and telling buyers not to buy because of parking problems they did something about it.

They had a word put up signs and now have put a big flower box in the place where he would park his van� that�s all ok until they leave site then I�m back to my own nightmare lol have you tried calling the police? See if they can do anything because I was told if he is causing an obstruction he can get a ticket.

if the van weighs more than 30 cwt about 1500 kilos your council may have a weight restriction on it .making it illegal to park on the highway overnight.this counts for 4x4s as well.
