No insurance but parked on public road

I put my car on the road for the sake of an hour to enable me to get a skip into the garden for a clear out. The car had no tax or insurance and was on a SORN, after returning from the shops i found that a snooper van had clamped the car (all within 35 minutes!!!!). I was basically forced to cough up £100 release fee AND a surety charge of £160 (refundable in 14 days if Tax is produced). The snooper van has informed the DVLA off the NO TAX offence.

Does anyone know if i will have been reported for no insurance (even though the car was parked up and not being used). I am aware there is a high possibility of going to court and being fined for no tax while on a SORN but will they check for insurance cover as well?

there is a chance that the snooper van people or the DVLA will contact the police. If Plod is involved you may well get prosecuted for no insurance. No doubt they took a picture so you are banged to rights.

how come you left the car on the road for 35mins, surely it didn't take that long to put the skip in place, didn't you notice the snooper van clamping your vehicle

so the skip was to be dropped off an picked up again all in the space of an hour??...mmmm.... if was only there for an hour...why go to the shops if you have a garden to clear?

get your story straight before making such claims to a court...

there is currently and has been for a couple of years.
due to no tax the right to clamp then sieze and crush cars with no tax.

how they gather locations of said vehicles would i "imagine" mostly be 1 or 2 ways ,
by the registered address and looking to see if vehicle is on the public highway.
and secondly by such vehicles being reported on the road by members of the public.

i can only imagine in your example that it was mearly a case of bad timing that your vehicle was seen " within 35 min's ".

This is enforced through means of the local police and their contracted recovery companies .
i have never actualy heard of a charge to remove the clamp , however that does not mean this is not done ,
I do understand that they will not remove the clamp or return said vehicle until the vehicle is again tax'd " as for back tax i have no clue sorry" however if the vehicle has been collected by the recovery company and impounded , i would imagine a cost would have to be paid to release the vehicle.

The vehicles are clamped until the recovery company can come and tow away said vehicle. this is obviously done to stop the vehicle changing location and being used .
These vehicles are then taken to a compound to await crushing.

any vehicle on a sorn or without tax has no place what so ever being on the public highway " for any lenght of time " .
that being said if the tax has just run out there maybe some time given but that again im not entirely sure upon

The adverts on the TV regarding this should be classed as a public warning and have been going on a long time.

with regard to no insurance ,
You cannot tax a vehicle until it is insured. i imagine once you have taxed the vehicle and claimed back your " surety " charge the matter would be dropped.
However a vehicle even just parked on the public highway should have insurance , and by moving your vehicle to its "spot" on the highway would mean you broke the law regarding insurance so the police would be acting within the law to follow this up, especialy if you went and gave a statement that you moved this vehicle onto the highway knowing you had no insurance.
I am afraid it is a wait and see process to know if they will or will not act.

A witness statement from the skip deliverer confirming you had to move your car for the timed use of the skip would assist you in Court.

you could perhaps have left a note of the windscreen explaining the situation - id imagine most would understand this and be prepared to wait an hour or so to check your story...

obviously no use now, but a thought for next time eh?

A car does not have to be insured to be on a road. Any person driving a MPV has to be covered by a policy of at least 3rd party. If you had a friend move your vehicle for you and their insurance police allowed them to drive other vehicles 3rd party the vehicle would have been insured while he was driving it.

The offence of no insurance requires the proof of someone using, causing or permitting the MPV to be driven with no insurance.

Basically if you moved your car you comitted the offence of No Insurance. If a friend moved it for you you would still be stung for no Tax as it is on a public road but no insurance is not a given fact it has to be proven that it was driven with no insurance.
