3 Point Turn - Who has right of way?

Hi all, I was engaging the 3rd stage of a 3 point turn on a long straight road, as I moved off there was a car coming from my left and despite being able to see from a distance that I was in fact turning he made no attempt to slow down and tried to get past me in the small gap in the road (front of my car was accross the middle of the road) as a result he crashed into the front left side of my car! Who was at fault here? Im a little confused as the driver of the other car was fuming telling me that your not supposed to turn on a road and that I shouldnt have moved when he tried to get passed me.
All views on this will be welcome especially if you can cover some of the legal aspects of this.

Let your insurance handle it, but going on experience. if you have a witness and you were stationary, you will win. I don't know about if you were moving.

He's in the wrong. Every learner has to practice the three point turn during their lessons, and may have to do it during the test, so it is obviously legal as long as it is safe to do so.
He should have given way.

when I did my lessons, the person doing the 3 point turn should give way to traffic using the road - however, if you were mid manoever and were stationary when he hit you then it's his fault, if you continued your manoever and expected him to be curteous and wait and he didn't then that is your fault. The key thing here is whether you were stationary or not.

British "rules" of driving are based on the principle of "Give Way" rather than any notion of "Right of Way" precisely so that collisions such as this should not occur - if both drivers had given way instead of thinking "this is my right of way" the result would be no collision.

That being said your manoeuvre included entering into a lane along which another vehicle was making progress. You impeded that progress. If you had completed your manoeuvre while on your driving test the result would have been an immediate fail, even if the collision had been avoided. Forcing another vehicle to take evasive action (e.g. even to slow down) is marked as a Serious Error; a collision is a Dangerous Error.

as above there is no such thing as "right or way". if you where stationary when he hit you then it's 100% his fault, if moving and closing the gap I'd say it's a knock for knock.

I think you are quite right ABerrant. There's no "My right of way". The old saying that it takes two to have an accident is perfectly true. It takes one person to break the rules and the other person to fail to avoid them doing so. It's the same with a fist-fight. It doesn't matter who started it, both are equally culpable if they choose to fight.

In this case in seems a bit of caution and common sense on both sides wouldn't have gone amiss. Certainly someone driving along a straight road should slow down when they see potential danger ahead but the person causing the danger should also be aware of traffic approaching and not continue their manoeuvre.

Sorry R-Mac but I think this is one the insurance companies will squabble about. Even if things go in your favour, I fear you might find your premium increase as you may now be classed as a higher insurance risk liable to cause accidents etc.

i have accident with some one performing a 3 point turn on a near by school as approach him i have a full clear lane to go while him finish the second stage of 3 point turn so the next stage for him will be check both side on coming traffic which looks like him check his right hand traffic and forgot the on coming traffic on his left as soon i cross in front of him on my left line him decide to drive the car and hit my van on driver side end door we stop ahead in the next turn and we check the damage on are cars and his reaction was i was doing a legal 3 point turn and i have to stop my car for him finish the second stage of his manoeuvre my answer back to him was as far i concern the person how performing any manoeuvre is responsible of any action and if was a motorbike our a push bike will be the same situation ,then i ask him would you like to go by insurance our you want to pay the damage i so is only my door and scratch then him say ok and him ask me how pay my , mi answer was goods know you hit my car and then i ask you have any proof of identification and was at ymc card so i decide to contact my insurance and report my incident
