My daughter has dual nationality and has lived here since 2017 - Brit passport, NHs #, pays tax and council tax and all the rest.

she didn't vote in 2019 but has been told that because she was born in the EU, in the neths, she is ineligible and you now have to have been born here, this a result of Brexit. Is this true?

I've also asked my goddaughter who is a lawyer in London and was born in Brussels....

Over to you....

Is she not a little late in querying this?πŸ™‚

Did you along with the majority of Brits  vote for Brexit yourself though? without knowing what you were voting for?

I don't know the answer but if it's true why wouldn't it apply to everyone born abroad?

//

be registered to vote

be 18 or over on the day of the election (‘polling day’)

be a British, Irish or qualifying Commonwealth citizen

be resident at an address in the UK or living abroad and registered as an overseas voter

not be legally excluded from voting//

https://www.gov.uk/elections-in-the-uk/general-election

// has been told that because she was born in the EU, in the neths, she is ineligible//

who told her she couldn't vote? we need to know

was it Hymie or gulliver1? πŸ˜‚

davebro 13.27.  And yet myself and 3.5 million expats can vote and help decide who we would like  to govern the likes of yourself without even stepping foot into the Country,,,

...........😎Thanks to the Tory Party.😎

DTC It's best you vote Labour today then. As they are going to change the law to allow EU Residents in the UK have the  vote.

If she hasn't received a polling card, is she registered to vote anyway?

Might be an idea to contact her local council to see if she's registered to vote.

It will only be one vote missing for the Cons which looks like will not make a lot of difference.

I see gulliver is a mind reader now too.  He knows how someone is going to vote without even knowing them.

exactly shedman - I have no idea of what she would vote for. she went along with her bf and was asking the polling staff in there. Why she didn't take up the cudgel beforehand, I don't know.

This is nothing to do with brexit. The rules have always been the same. A British citizen can be born abroad and the rules for that are well established. Diplomats, forces etc. If she can't vote it will be because of negligent parents. End of.

Plenty of UK citizens have been born abroad.

EG Boris - New York

Joanna Lumley, Cliff Richard - India

Was she registered at the British Consulate in the Netherlands and does she hold a British passport. If yes then she should be able to vote. My daughter was and has voted

Question Author

Yes she was registered at the Brit consulate

still not told us who said she couldn'tπŸ™„

From the Electoral Commission website:
"How should an elector with dual nationality be registered?

Some applicants may have more than one nationality. You should always process an application in accordance with the nationality that provides the higher level of franchise.

For example, an application stating that the applicant is a dual German and British citizen should be registered as a British citizen, as this gives them the wider franchise."

Thanks Chris - it seems that her holding an american passport as well as her UK one is the issue - what I am reading between the lines is make the application, get rejected but they have to give the reasoning and steps to take in re-application. Tedious? Probably yes.

Davebro - read 14.03 more carefully than you did if you read it at all.
