Botched facelift

This lady had elective surgery , which tuned out not as she had hoped .
Going under the knife is never risk free
She claims that the surgeon performed experimental surgery on her - which is denied by the surgeon
Where do you stand - Does she deserve a 6m payout from something that she chose to have done , out of vanity ?

I had elective surgery several years ago (Bullectomy and Pleurectomy), it was not life saving surgery but much needed. If mine had gone wrong due to the surgeon using experimental techniques I would hope my family would have been entitled to some sort of compensation from him after my death.

I would only have an operation if it was absolutely necessary. I cannot understand anyone being willing to be cut about for vanity. If it was some terrible accident that could be corrected, yes. If it was something which someone was born with which would spoil the rest of their lives, then yes but this woman looked very nice before the operation, so IMO it was not necessary. However, the surgeon took money to give her what she wanted and botched it and so he must pay for it.
I don't think her motivation matters. If I choose to get my car repainted red, because I like red, and the guy paints it blue, I've got a legal case, as I would have against anyone who took my money and then did a bad job. But it's up to the court to decide whether what went wrong was a predictable risk or not.
Who said it was experimental?.....Not the surgeon.
Was it or was it not negligence on the part of the surgeon?
A poor end result doesn't necessarily infer negligence.
Did he warn her of a possible facial paralysis? If yes, then there is no claim on the surgeon if there was no negligence.
My opinion...the judgement was correct......£6 million is about right.

I posted this because I was listening to the radio , where this was been discussed .
It was particularly striking that those who phoned in and stated that she deserved the amount of compensation she was awarded ; as opposed to those who stated that she didn't , was about in the ratio of 3/4 / 1/4 against .
The views on here so far would indicate the other way round .

Jack- that does shed a quite different light on it, thanks/
Sqad- I would expect compensation, yes. But not that much. Not more than some poor sod of a soldier who had served in Afghanistan and had his limbs blown off or lost his eyesight. This was not necessary surgery.
And as for the boyfriend - I like to think he's with me for more than my looks.....
