I think you may have misunderstood this. As I read it the government can legally withhold benefits in certain cases.

Ah I see, I read this "A challenge to the UK's right to deny some EU migrants child benefit and child tax credits has been rejected by European judges." - and assumed that as usual we where shafted, it seems a rare decision in our favour! - apologies all please ignore.
Of course, if I were a sceptic (moi?) I would say this decision has been taken for purely political reasons, to try to stem the flow into the Brexit camp.

The judgement is not suspect as it was based on a legal argument. But the timing of conveying this good result might be, if one were cynical.
