The three appeal judges in San Francisco have declined to reinstate President Trump's executive order revoking visas
so the borders are still open .... ( ish )

the appeal was about the Judge Robart's granting a temporary restraining order
hence the long bit about whether the two states could bring the case ( doctrine of standing - locus standi in er english law)
and whether Robart's TRO ( temp restraining order) was appealable. Normally it isnt
I think even Trump thinks it was about whether his exec order was lawful ....it wasnt

Was the ban on those with visas and no new visas issued?
Depending on what was in the ban, why doesn't or indeed didn't he just order no NEW visas until they had sorted out the due process for vetting?
He just seemed to jump the (terrorist) gun and go out the barn door half cocked.
If he had not been so extreme about it and couched his words and actions with less inflammatory words and phrases do you think he would have gained a better 'ban'?

Saw that news and smiled. It's fun in away watching the most powerful man in the world being so publically neutered.
Reading the judgement is also rather fun -- the case for the Appeal by the Government is so roundly trashed and dismissed that I wonder who came up with it. Presumably not the lawyers who presented the case on behalf of the Government, who must have seen how transparently obvious it was that the appeal could not succeed.

Cassa.....the answer to your question lies in the character of Trump himself.
He is used to making policy up on the run, so to speak. He is also used to be obeyed, and he has little experience of being challenged at any level.
Almost all politicians at a high level, will have come up through the ranks, as it were. They will have vast experience of committees, where cases have to be argued and debated before being adopted.
Trump has none of that experience. He was hoping to hit the ground running last month and he has found, to his cost, that it doesn't work that way !
Although he still doesn't seem to realise that he just can't carry on being impetuous and childish. He keeping digging these holes that he made and he keeps on digging.

What makes me smile is that the Right, having been soundly beaten in the US *and* the UK, still don't get the message that the Courts are important in trying to preserve the law. And then that to seek solace they stoop to the rather pathetic assertion that not condemning Kim Jong Un daily amounts to putting Trump and him on the same level.
Still, I guess you have to find comfort somehow.
