hi my friend attacked this man and i was wondering what is the most he could get plus he has never been in trouble before and he is depress

Community service should be what he is aiming for. For a first offence and if he agrees to plead guilty he may escape a jail sentence with community service.

Ask the lawyer who is defending him.

The maximum csentence is no guide to what is normally handed down.

To answer the question - it's a statutory maximum of 5 years.  (S)He can't get longer than that.  see s.20 of Offences Against the Person Act 1861. 

my friend got done with GHB he had a fight with a guy after a club we where at, he got a fine of �200..

his lawyer would be able to tell him wot is likely to happen.

Are you sure it's GBH not ABH by the way?

GBH holds a max of 15 yrs

GBH with intent holds a max 20 years

ABH holds a max of 5 years

Common assault max 6 months (summary only)

depression is not a defence, mitigating circs only.

sam82 is talking sugar mice. �200 fine is a level 1 fine for a level 12 offence. Impossible.

Ok WM - thanks for correcting me.  I was looking it up on the internet and must have used bad information.  I've never purported to be an expert on criminal law, and as I'm sure you'll understand very well, a law degree is not a pub quiz, nor is it a memory test.  Therefore law graduates will not know the answer to every question like this simply because of their degree.  I have therefore never claimed that. 

I'm sure you take great satisfaction in correcting me, but I assure you the pleasure I take is in knowing that the user is now getting the correct answer.  What's the source by the way?  Just for my future reference please!

I have a conversion degree in law JB after I came out of the Army. Source therefore, my own mind which may be deemed with suspicion!!!

So you actually sat down and did fact learning!  Cor - tells me a lot about the CPE does that.

I hope your friend gets help for his depression.  My ex suffered badly with it and used to just turn into a total stickhead (you know what I mean!) on down days.  He was never violent, but he was (maybe still is) a horrible person to be around during those times.  Knowing it'snot really their fault and that they need help makes it so hard!
