If that is the case then the driving ban would appear to be enforceable for three years?
The problem with the ban only starting when an offender is released from prison is that someone would have to keep records of which prisoners had driving bans and of when they were due to be released so that they could inform the DVLA. The prison service would not want to do it as they have more work than they can cope with anyway. You could not rely on the prisoner reporting himself so that the ban could start. A one year sentence means automatic release at 6 months with up to 4 months served at home on 'Tag'.So a one year sentence can be only 2 months in jail!
