The problem is that of late what constitutes rape has been greyed to the ridiculous. Not saying it's right or wrong but go back 30 years and this case would not have been brought. Then there are the malicious "victims" that wield power to ruin lives because of a perceived slight after the event for example. The safest way is name neither I guess.
The various defences a man deploys against rape accusations are already pretty demeaning to the woman as it is. That's not exactly their fault, per se -- what other defence is there to the accusation of no consent being given other than "she was gagging for it and always has done"?
