Why Should Being Gay Be A Sackable Offence In The Us?

Years ago I watched a TV documentary about military police. They hounded some sailor and he was thrown out of the Navy for being gay. I was pretty annoyed/upset that this could happen. It looks like the bad old days could be back.

This chap was sacked for groping a female 'pupil'.
His defence was 'Can't sack me, I'm gay'
Several courts appear to have ruled against him.
This will probably go to the supreme court.
I don't know, I know as much as you, but maybe the DOJ don't want this case to set THE precedent.
Ie. everyone who gropes a female colleague can use the ' Can't sack me, I'm gay' defence.

What has a persons sexuality to do with work?

I suppose there is a clause in contracts that says something about conduct and bringing the company into disrepute but that should surely when something happens not 'just' because of their sexuality.
