In Australia it is also an ambiguous situation. A pedestrian who walks into the path of a vehicle is at fault. However a vehicle must give way to a pedestrian who has already begun to cross the road. When someone steps onto the road they become a road user and I believe they should have a duty to pay attention. Any other road user looking at their phone is committing...

Cyclist was going too fast to be in total control of his bike. Otherwise he could have simply stopped.
The fact that a pedestrian isn't looking where they are going doesn't give you carte blanche to run them down.

Good that he had an airhorn on his bike as bikes are not required to be fitted with bells in the UK. Oh except when they are in the shop but not on the roads. How ridiculous is that. I will make them compulsory when I am PM.

Spicerack. who said anything about 'rights'? If she fails to look where she's going and steps into the path of a bike - or a car - or a bus - she shouldn't be surprised if it hits her.
She didn't step into his path. He saw her in the road, hence his air-horn, shouting and swerving. She panicked and tried to jump back to the nearest path but unfortunately he had already decided to swerve around behind her back.
He was an out of control rissole.
