""There had been an assault upon her previously, and the defendant was getting more and more irritated and took her laptop off her and threw a knife at her, which bounced off.

"He beat her and he told her to take her clothes off and stand naked in the shower, making threats he was going to kill her and held a knife to her throat.""

In my opinion he's a danger to women in society.

If I am reading the report correctly, this thug has already breached a suspended sentence by committing these offences, so I fail to understand why his original sentence was not then enacted - as I believe is the point of suspending a sentence in the first place.

Aye Andy exactly!

"He battered his ex-partner so violently she needed two titanium plates and screws to repair the damage to her jaw and fractured cheekbones."

"Brooks was said to have one previous conviction for a drugs offence in August 2017, for possession with intent to supply cocaine and MDMA."

From the sound of it he's a permanent danger to all of society.
How did the decision not to gaol him get made ?

I have no idea OG it's gone over my head.
I thought he'd been sentenced to three years this time? I read that he committed these crimes during the period of his suspended sentence, which he was given in 2017.
If someone had caused these injuries and asked in the Law section 'what am I likely to get' The usual people would come in saying a minimum of 5 years yada yada yada. You never can predict what the sentence will be.

I've worked with people with ADHD and Autism and yes, they can be prone to outbursts, but these weren't just outbursts, they were cruel and sadistic. He should have been locked up!

He has been spared prison. The reasons for that are at the bottom of the article..

"In mitigation, his defence lawyer Rosalind Emsley-Smith, said: "What I submit is a fully exceptional set of circumstances.

"He has stopped fighting against his diagnosis and being ignorant about it, and taking his problems out on those people around him and self-medicating.

"He is a man who has learned to accept the diagnosis and difficulties that has impacted those here, and those around him.

"He is more able, and prepared to work with his diagnosis and medication regime."
Spath, the Daily Mail headline and article say he was sentenced to three years.

I am torn then. This article was updated today. (7th august)

Yet more stupidity from our justice system. He's clearly dangerous, but I suppose someone will have to die before any real action is taken.
..Just reread it. It does say he was jailed for 3 years, as he was already on a suspended sentence.
Thanks, Ludwig - I thought I was the only one who was seeing the sentence, the facts about offences committed during the suspended sentence and so on.
Thanks for the link, OG. I mentioned the 'offences committed during the suspended sentence' part earlier, but Spath then went on to talk about 'being spared prison'.

thats what it says in the heading of the metro.

"Malakye Brooks, 25, of Morecambe, Lancashire, subjected his girlfriend to three months of 'violent and humiliating' abuse but has been spared prison"
I haven't seen the Metro piece, Spath, but your Mirror link has a photo with 'sentenced to three years' under it. The article itself is … rather confusing.
Even if 3 years is trhe sentence (Realy 18 months) this is still pathetic.

Savages like this need locking away.
