I suppose it's one way to advertise your business but is it too much to hope that the Court will throw it out?

I keep thinking ''only in America''

//She can refuse though, just don't give the reason, just say you're fully booked.// It’s a sad indictment upon the society we’ve created when laws prohibit the truth and lies are not only encouraged but deemed acceptable.

If you want to refuse someone a service then you should be able to. I've been told on a few occasions to 'get out your sort drink in the Bell'
//Which was bleedin' obvious to anyone with an ounce of common sense from the start NJ.//

Unfortunately, Ludders, common sense is in short supply when it comes to the rights of those who believe they have suffered discrimination. This is evident from the fact that Mr Lee is still not satisfied by a perfectly rational decision (explained in full) by the country's highest court and is now trotting off to Europe to try his luck (with other people's money) there.

//Unbelievable that it dragged on for so long.//

££££££££££££s (soon to be €€€€€€€€€€€€s. Kerching !! :-)
Would a court in this country consider a case asking for a determination on a hypothetical situation?
what I don't get is why Sesame Workshop have remained silent through all of this. despite what this or that pressure group might think or say, Sesame Workshop maintains that Bert and Ernie are not gay.. Mr Gareth Lee would be (presumably without copyright permission) misrepresenting the characters, no?
Any business does have the right to refuse to provide a service, however, it's important to ensure this is not discriminatory. If you refused service due to sexual orientation, or due to gender, then that would be discriminatory.
Sex is a protected characteristic. Gender isn't.
"however, it's important to ensure this is not discriminatory. If you refused service due to sexual orientation, or due to gender, then that would be discriminator"

So would you want someone who hated your lifestyle taking your precious wedding photo's?

I certainly would not.

And where does it end. If a known gay hater asked a gay photographer to take pictures should that photographer be 'forced' to take them? Works both ways.

You can legislate and shout all you like but you can never change peoples thoughts only drive them underground to fester and pop out in peculiar ways. Best two conflicting viewpoints are allowed to be separate to get on with their own lives I say.
"Sex is a protected characteristic. Gender isn't."

Yes it is. Sexism is a form of discrimination. If you had a lemonade stand and you refused to sell lemonade to females, that would be discrimination and illegal.

Of course this doesn't apply for all services but it does apply for most products.
Yes, thedevil, as I said... that is about sex not gender.
I'm not sure what you are on about. Maybe I simply do not understand.
Sexual orientation is being homosexual or bisexual. Gender is male or female.

It is classed as discrimination to refuse a product on the grounds of sexual orientation or gender.
Clearly not... sex is male or female. Both are protected by law- whether that means giving them identical rights, or different rights, because they are different. Whichever ends up "fairest".
Gender is more about how you feel, and frankly, nobody cares how masculine or feminine you feel yourself to be- it makes no difference to anyone else, anyway.
Sexual orientation, or sex, thedevil. Not gender. And other categories too, but gender isn't one of them.
Pixie374, you seem to have your own interpretations. That is fine but please don't imply my answer is wrong like you did at 13:48 when it is not.
I don't, I am using the actual interpretations. Because that is what the law uses. I can't see an answer of yours at that time?
Evidently comprehension isn't a strong point.

Not to worry. Have a lovely day.
Ah, sorry... my answer. That is correct. Look it up in the law, if you aren't sure.
I know, hon, I'm used to you-)
Sex - basis of their reproductive functions. In other words.. Male or female. That is gender.

If you refuse to serve someone a burger because they are male, then that is discrimination.

Do you enjoy pedantic discussion? I certainty have got better things to do.
You don't seem to- and biology is sex, not gender.
