Starmer now says he'll call a motion of no confidence if Boris says he's staying on as caretaker. Seems fair enough to me.

Yes but the tories have a massive majority so no chance of that succeeding. As much as the Tories are rebelling they won't want to be unseated and out of power. Sir Beer is just trying to optimise the situation for himself, he knows this is a close as he'll ever get to no 10.

A successful motion of no confidence doesn't have to result in a General Election. If, within 14 days, the Tories replaced Boris, they could then table a motion of confidence (which they would clearly win). So, if the Tories really want rid of the clown, they could safely vote with Labour in a no confidence motion.
Yes, Starmer does need to be careful.
That said, he’ll resign if given a FPN, I don’t see a problem with that.

Rumour is he was allegedly given a FPN last Friday and has taken out an injunction. How true this is I couldn't possibly say.

Past resigning PMs have stayed on until a new party leader is chosen. If he actually goes then there is a constitutional conundrum, same question came up when the PM had COVID, discussed here:

People may say the Deputy PM could take over but that's not really a post in reality. Logically the deputy leader of the party is the new leader of the party and de facto PM but would that wash? we don't know because it's never been tested. The PM will stay and the party will elect a new leader PDQ. That's what happened with TGL, they managed it in 6 days.
Didn't Cameron beat a very hasty and almost instant retreat once the result of the referendum was known? I don't remember him waiting until a new leader was elected - although I might be wrong.
He left about three week after announcing his resignation. There was an election process during that period and Andrea Leadsom withdrew, leaving May as the only candidate so she took over.
Yes Naomi but he was still PM, he resigned the day after the BREXIT vote on 24/6/2016 but was PM until TM took over on 13/07/2016 it was only a couple of weeks because the potential candidates pulled out leaving only TM. He was PM but did not attempt to enact anything.
It seems Starmer is after a new Government so it would be a vote of no confidence in the Government.
