An Intermediate Diet is the Scottish equivalent of the English Plea and Case Management Hearing. Defendants may or may not be in custody at this hearing (though must appear in court).

Distinguish between the police and the Crown Office and Procurator Fiscal Service (Crown Prosecution Service in England) who bring the case. Trials are often preceded by Bail Hearings and Plea and Case Management Hearings.

The charges can be dropped by the police at any time. Similarly the case can be dropped by the prosecution at any time. However it is unlikely for a case to be brought to trial without some good evidence.
