Surely the person that spiked the drink would be the one to blame?
Question Author
maybe but that person is not going to hang around are they? or it has to be proven as some pubs have no cameras.
the person that spiked your drink would be ultimately to blame, to reduce the risks just have a ciggy on your way to the bar after you've finished your drink.

if you did get spiked i doubt you would be able to sue anyone, except the culprit but then thats not really going to be very easy.
It's not worth suing anybody unless they have the means to pay compensation.

And it is a moot point that you could claim for damage to your health as you are a smoker - you obviously have scant regard for your health.
why is your first instinct to sue? Take some responsibility for god's sake. What if you got stung by a bee outside - who'd you sue then?
Aren't the smoking areas mostly in beer gardens...where you can also take your drinks.....
how many town pubs do you visit that have bar gardens? We have pubs galore in my town (well that and kebab shops), not one of them have a garden.

Surely the sensible thing would be to finish your drink before you potter outside for a smoke?
sorry...beer gardens.
Ok beer gardens are probably more a rural thing but quite a few pubs have some sort of terrace or patio area even in towns..

well a few have put a token giant umbrella outside- we're hardly cosmopolitan up 'ere!
If you're talking about the Rohipnol drugging of women - well there is such a culture of binge-drinking in this country that thein many occasions there's no real need to spike with illicit drugs, just keep the breezers coming and what for Blotto Time. And no I'm not making a moral judgement on bingers. I believe we should all have the right to get as mullered as we like. But being realistic, there is always going to be a weeny percentage of weirdos scouring drinking establishments looking for prey. But I'd be interested to see the latest statistics on the reality of true spiking. IIRC, the odds of being targeted with - say - date rape drugs are not much greater than having them spiked with polonium. As a female I remain more cautious about brawling with glass flying everywhere. :(
I mean other people brawling with glass flying near me.
Almost every pub in my town has a garden, patio or pavement cafe. One of the nightclubs now has a smoking cage which is a bit weird.

Who would I blame if my drink got spiked? The person who did it and me for leaving my drink unattended. Its not like there aren't posters up all over town advising you not to do it.

I have always wondered about guys who would take home a woman who is blindingly drunk. It doesn't seem far off the spiking of drinks to me. Girls rarely go out on their own and I would never let one of my friends go home with a strange guy when they are p1ssed.
Can you not finish your drink and then go and smoke if you really can't take it outside? (Most pubs seem to have beer gardens these days).

And who do you blame if your drink gets spiked? Erm, the person who did it?

I'm not entirely sure where/what this question is leading to dookey

Why would you sue anyone? If your drink was spiked and you were a victim of crime as a result surely that would be the least of your worries?

Or am I just to tired to understand?
since the smoking ban came in in Scotland many pubs that did not have Beer Gardens/Smoking Terraces now have them. I think you are responsible for looking after your own drink - therefore leave it with a responsible friend or finish it before you go outside.
