Problems with amnesia (1) that the defendant cannot remember does not stop him being tried fairly
2) it's not a defence [Case is Rv Podola. He tried those and was hanged !]
In the instant case we may expect a similar failure.
On a purely factual basis, 'he must forgotten, within moments of it happening, that he did not drown. Otherwise he'd have gone straight to tell people he was still alive. And that's only the start of the examination.. !
I know. There are a million ways he could slip up just via an interrogation. They could use loads of news items to test him. Wars, hangings, what was happening in Eastenders when (his wife...as men always say) last watched it. He's bound to slip up somewhere.
