In the UK rape is rape, inside and outside marriage; that is statutory law. If one's consent is not present, by what sleight of hand mental transfer can we claim to have a right to inflict carnal assault on anyone ? Women (all of them) have the human right to say no.
Any husband who disagrees had better get used to the idea of many years behind bars.

Isn't this a slightly ridiculous question though? No sane person who considers them under the jurisdiction of english law is going to agree. Isn't the problem that sharia law defines rape as "adultery by force" and because there cannot be adultery in a marriage that is why it cannot be rape? It's still abhorrent, whatever you call it. I don't know if Sharia law would actually punish a man who did this - the chap suggests he can be "disciplined" or "reprimanded" (you naughty boy?!) or that it could be considered indecent activity but who knows!!!

There is a difference between rape on someone in a relationship and a strager hunting down and raping a woman.

The law may treat both as the same offence but we try to grasp the difference with terms like "date rape".

If he'd sid that there was a difference in serverity between these two cases I think many people would agree with him.

He seems to be reserving the term rape for the latter type of offence.

There is a worrying issue about the terms reprimanded and disciplined as too weak in these cases but fundamentally seperating these two types of offence is not that extreme an idea
