You are right kosoro with your answer in respect to the fact that the clue states 3,3,3, 4,4,4,3,3,2. However, the 'can not' is open to debate as it is usually related as 'cannot' The word cannot heralds a long page on dictionary.com, which is something crossword compilers should inspect don't you think?
