If the problem is wholly the fault of the supply company, you can insist they send a prepaid post label for return of the goods. Tell them, if they don't, you will charge them a weekly storage fee of £5 per week for a year, until they owe you £250, when you will consider they have abandoned their rights to the goods.

Did you sign for them? Were they addressed to you?
Legally, you havnt paid for them, and human error that you have got them.........why not return them?
What size are they? Will they fit?
And who sent them?

they were addressed to me,wife signed for them, company want £3.95 for returns note and lable. (no chance)
Where were they ordered from?

wrong size i take 7 these are 8.5

orderd from MAILSHOP
You'd be better sending them back. I once lived in a bedsit and somebody in the same building ordered CDs using my name. I eventually got the letters asking for payment. When I refused they put a mark on my credit rating. So eventually when I did want credit I had to pay to have it removed.
Just tell them that you didn't order them so are unwilling to pay for the return. If they want them back they can arrange collection.
Simple,....just send them back,there will be a delivery note with them which enables you to return them.Just read what it tells you to do.
This has happened to me in the past with something. I rang the company immediately and told them and they said not to worry, thanks for being honest and they would send out the goods to the correct person and keep the item (can't remember what it was). I have always found honesty to be the best policy.
As you did not order them, if they want them back they have to arrange collection at no cost to you, within a reasonable time-six weeks I think. If they don't you are entitled to keep them or dispose of them.
Just for clarification, do you have any kind of order history with this company?

It's entirely possible that a namesake of yours placed an order, someone tapped the name into the database and, lo and behold, up comes your address details.

Nevertheless, it does seem -odd- to despatch the goods without having first extracted payment from you. Have you made sure there is no trace of this purchase on your (or your wife's) PayPal account, credit card or bank account?

Other than that, I agree with ummmm; for misdelivered items, I think it's up to the retailer to arrange collection.
david- I'm puzzled by your two posts that say:

* wrong size i take 7 these are 8.5

* orderd from MAILSHOP

Are you saying you did order some shoes but they sent the wrong size?
I think he meant they were sent by MAILSHOP.
Until you notice your card has been debited.

I think david means supplied rather than ordered.
I understand that you ordered them but that they are the wrong size. Therefore you need to discuss it with them. If the fault is with them then they should not expect you to pay to return them.
david- please can you clarify whether you :
(a) did not order anything from this company; and if you didn't, have you ordered anything from them previously?
(b) did order the shoes but they sent the wrong size

The action you need to take depends on what the problem is.
I think david just wants us to tell him to keep them and sell them on ebay.
