Argh stupid person on ebay!! xbox 360 game damaged...

I bought an Xbox 360 game for my Boyf on ebay the other day, it arrived to our work address, he opened it, and all over the disk there were huge scratches, including a complete ring around the disk where it had obviously been played so many times. i emailed the seller instantly saying we would test it when we got home but didnt hold out much hope so would expect a refund. the disk didnt work...next day emailed him and set up a paypal dispute, he is saying that we scratched it whislt playing it, but why would we do that when we emailed him whilst at work, straight after delivery and even went to the hassle of buying it, to then ruin it and send it back. luckily we did take a picture which was dated and timed. He declined my refund request within the paypal dispute and now im worried i wont get my money back....what are the chances? anyone else ever had a problem similar? what was the outcome?

Thanks guys, fingers crossed i will get the money back then...why is the bloke being such an ars*? he surely doesnt think i ruined the game...what would i have achienved??? its not like in the 2 monutes it took me to write the email after receiving it i could have completed the game and then decided i would try wangle my money back!?!?
