I ordered a cardigan from this company on 29/11/09 - still not received. I've tried phoning and, as you say, it just rings constantly. Also emailed them but they haven't responded. I've contacted my credit card company and they are disputing the payment - had to complete a form with all details and copy of my email. I've also contacted Consumer Direct who have advised me as below.
" From the information you provide, in failing to provide you with the goods ordered, the trader may be in breach of contract. This would depend if there was a specified timescale for delivery of the goods in the terms and conditions of the contract. If the trader has not delivered within this timescale, it could be argued that they have breached an express term of the contract. As a result, you would be entitled to a refund of monies paid for the item, including postal charges.
Furthermore, when goods are ordered online or over the telephone, the Consumer Protection (Distance Selling) Regulations 2000 will also apply. This law states that when goods are not delivered after 30 days, the contract can be treated as automatically cancelled and the trader must then provide a refund in the next 30 days.
I would advise you to write a formal letter to the trader, you should send the letter by recorded delivery and keeping a copy of the letter that you write. You should state the legal argument made above and request that they provide the item, or a full refund of monies paid within a reasonable period of time (i.e. 7 working days). "
As it's been impossible to contact voijeans, Consumer Direct suggested that I check out the company first with Companies House Tel: 0303 1234500 - I'm going to do this tomorrow. I'm still getting newsletters from voijeans so presumably they are still taking orders.
