It's a story and a half....take it at face value and Pilate and Herod appear not to think much of the charges trumped up against Jesus. Pilate wants to punish him and release him, Herod thinks it's a joke, humiliates him and sends him back to Pilate. Then along comes the convenient mob of Jews who clamour for him to be killed and Barabbas the thief released instead....can you say setup?
I wouldn't worry about it; it's plainly nonsense.
The idea of Pilate reasoning with a Jewish mob and then giving in to them is laughable. His way with such crowds is well-known: he would slaughter them, often having his soldiers in plain clothes mingling with them so that they could start the killing from within.
Imagine Himmler facing an argumentative Jewish assembly and you get the picture.
